I am sorry but as far as I can tell from reading the information, the man was unarmed in a interrogation room? All information about what he has done before the event does not make it right to kill a person. So the question is does shooting a unarmed man in a interrogation room justify as self defense. I can hardly imagine a soldier not capable of containing the unarmed subject without killing. Also i can not imagine a person trying to kill a solder just before he is getting released without invoking it.

Without survalence footage, it is just guessing, but I can only explain a bit why he would get charged with murder.

EDIT: after listening to the radio broadcast it seems that the soldier has been ordered to take the person home, but decided to interrogate himself on a rock with a interpreter while pointing a gun at him ?

There is a trend going with prosecuting our elite forces. 3 Navy seals are beaing prosecuted, because one of the slaped a known terrorist. The same terrorist that killed, burned and chopped the bodies of 4 US contractors. The question to ask is, what would he do to our navy seals, if he had captured them???? Slap them like one of them did to him, or would he kill burn and chop up their bodies like the other 4???

not saying that known terrorist shouldn't be slapped..but i've heard some argue "shouldn't our soldiers be held to a higher standard? otherwise what are we doing over there anyway?"

LOL, yeah i heard that before. You have to remember that 90% of the insurgents are being trained and sent to Iraq from Iran and Syria, basically the iraqi ppl dont like them, Because they know what that does to their country. I know this for fact, because im an iranian. If US keeps punishing our soilders for stupid things, there wont be any new ones that will sign up. In a face of war, slapping someone is nothing compare to cutting someones head.

I see the attacks on US troops on a daily basis.  They are mostly just to annoy us and really do no harm.  It is hard to deal with daily when we really only want what is best for the Iraqi people.  After being deployed over and over again, Troops build up a lot of animocity.  They need to take the higher ground though.  But, if they don't, they don't need to be publically prosecuted.  I believe that the government is prosecuting to just make a statement to the Iraqi's. 

**  I also forgot to mention that those bastards are now using our rules of engagement against us.  They are shooting at our troops and convoys, and then throwing their gun down, and walking off in a crowd.  If they are not armed, we cannot do anything.  Really, we can't do anything anymore unless we "fear for our life"

Campe23, first i like to say Thanks for your service. Also, i believe it they had let our troops do what they were trained to do, we would have finished this war years ago.
Funny thing is that, Obama is giving known terrorist like KSM and others a Civilian Trial, but court marshall for our troops. I guess this is the Change we can believe in.

You can kill a person in 3 way's 1degree 2degree and torture. Both parties allies and terrorist know that torture is the most effective one for gathering information. Obama statement saying we don't need torture, is valid as long allies have the upper hand. We all know when US put down the hammer, its game over for citizens and terrorist. The justice system is trying to enforce this rules of warfair without torture and examples like in this case need to be made to prove the point. The reason for court marshal is because soldier are made of steal that do not bent and stick together. Civilian court simple has no effect on them. Also note that chopping people after they are dead, does not count as torture. To torture some one you really have to be mentally strong to do this kind of stuff 99,9% of all human beens do not have the balls to do this. Average terrorist prefer to blow them self up then to torture the person. I agree its totally unfair, but everybody can choose. I forgot to the name of the person who once said this "A general can order a soldier to walk in front of the enemy canon. But can not take one penny of the soldier salary, because that would be unjust"

Thank you for the support.  I agree that this country is way to politically correct and to touchy feely.  I wish we could do what we need to do, but America is too worried about hurting the feelings of those blowing us up.  Just frustrating as hell.

Nah, the best thing to do at the time was allow Blix to get on with his job. There was plenty of time. The Iraq regime was no threat to the West. The rush to war without clue is part of the reason it has been such a disaster.

Let's face facts here. Iraq has been a disaster and this soldier is in prison because he didn't do what he was asked to do. Instead of taking someone home like he was asked to do, he interrogated and shot the guy.
